SECTION 9
OUT-OF-DISTRICT PLACEMENT

If the District determines that a student's IEP cannot reasonably be implemented within the District, the District may pursue an out-of-district placement. If a student who requires special education and related services is placed outside the student's resident district by the District, it is the sending District's responsibility to assure that an IEP is developed and implemented. The sending District is also responsible as well as for all costs associated with the transfer. The District must obtain the consent of the student's parent before the student may be transferred to an out-of-district placement. The withholding of consent by a parent does not relieve a school district of the obligation to provide special education and related services to the student. Only in the event that no in-state placement is available in which a free appropriate education can be provided, may the student be placed outside the state.
